Special Education

Special Education can be confusing and challenging for parents. Millwood Group LLC provides individual consultation and support for parents to help them better understand relevant aspects of special education law, regulations, procedures, state standards, and resources for their use in problem solving situations.  We work with parents to determine and implement the best strategy for their child.  This may be approaching the school for an IDEA or Section 504 evaluation, reconsideration of a completed evaluation in which a child was determined to be not eligible, referral to another professional for a private evaluation or additional testing, or revising a current IEP or Section 504 Plan that is not effective.  We will attend meetings if needed

Section 504 Compared to IDEA

Section 504 of the Rehabilitation Act of 1973 (Section 504) is a federal civil rights law that is designed to eliminate discrimination on the basis of handicap. Compliance is mandatory for schools that receive any federal funds.  The Individuals with Disabilities Education Improvement Act (IDEA) is federal funding legislation that supplements the cost public school districts incur when they provide free, appropriate, public, education as required in Section 504 and IDEA. While almost all public school districts participate in IDEA, participation is voluntary. 

Under Section 504, a child, who has been evaluated according to it's regulations and is deemed to be qualified, is entitled to a free appropriate public education (FAPE) and may receive accommodations, modifications, and some services. Unlike IDEA, Section 504 does not require schools to provide an Individualized Educational Program (IEP) which includes a statement of the child's present levels of performance based on progress monitoring, measurable goals and objectives, specially designed instruction, related services, accommodations, and more. Section 504 also makes fewer procedural safeguards available to children with disabilities and their parents than under IDEA. However, Section 504 is a law that is very focused on what is ultimately important for a child with a disability who is not eligible for an IEP - access to the general education curriculum.
